Unseen GST Delays Costs (It’s More Than Just The Penalty)

gst delay impact on buyer itc.

n business, certain things can be very costly under GST. One of those things is stating, “I’ll just do it tomorrow.”

Most of the business community is well aware that there is a daily penalty (generally Rs 50/ day) for missing GST deadlines. Most have a mentality that this is just an added cost of doing business. However, at Bharatiya Tax Pro, we have experienced that the penalty is the tip of the iceberg. The substantial hidden costs are far more menacing and can further suffocate your business’s growth.

In the world of GST, there are a myriad of reasons why “late” is far more complex than just being “late”. Let’s investigate that.

1. The Interest Trap: 18% and Beyond

There is a penalty for being late, but there is also an interest cost, and it is even more damaging.

For every tax liability that exists and is to be filed, an interest of 18 percent is charged every year for as long as there is tax that is required to be payable in cash.

To make things worse, if input tax credit (ITC) is claimed incorrectly, or if the tax liability is reduced incorrectly, that interest jumps to 24 percent. Contrary to the delayed charge, this interest is not capped. It is always moving and only stops once the payment is made.

2. Credit Blocklisting Customers (Permanently Damaging Your Business)

This dangerous business-killing myth is costly. Filing GSTR-1 late results in your sales not appearing in your customers’ GSTR-2B.

Consequences: Customers cannot avail of Input Tax Credit (ITC) and are unnecessarily burdened with additional taxation due to your inefficiency. This is Bengaluru’s competitive vendor ecosystem—tax credit blockers are quickly vendor-switched.

3. The ‘Blockade’: E Way Bills and System Lock

Aggressive use of government technology to monitor non-compliance.

  • E Way Bill Lock: If GSTR-3B is not filed for two consecutive months, the system will revoke your access to generate e-way bills. If you cannot create an e-way bill, you cannot transport the goods. Everything comes to a standstill.
  • GSTR-1 Lock: If you have not submitted GSTR-3B for the preceding month, GSTR-1 is also locked for the current month. Such a loop becomes a Compliance Spiral, which, even in the best of circumstances, is extremely challenging to break.

4. You cannot ignore the cancellation risk (The “Death” Penalty)

If you do not file tax returns every six months, the GST authorities can cancel your GST registration.

Losing your GSTIN is a nightmare. Getting it back involves a lot of paperwork and a long, complicated, and bureaucratic process. You can’t do any business or issue tax invoices during that cancelled period.

5. Impact on Your “GST Compliance Rating.”

The Compliance Rating program is in the GST laws, but it isn’t available yet. By 2025, you won’t qualify for business loans or credit lines without a “Filing Consistency” rating. The absence of tax returns indicates that the business is disorganized and has cash flow problems. This makes you a ‘High Risk’ borrower. The rating will reflect a history of failed tax submissions.

How to stay ahead of the clock

While careless tax submissions and a lack of structure can cause filing delays, in most cases, late submissions are beyond the taxpayer’s control.

  • File Nil Returns: Even when you are out of business, you should file a Nil tax return. The late fee applies to zero returns anyway.
  • Use the QRMP Scheme: If your turnover is below Rs. 5 Crore, you are eligible to file for a quarter but pay for a month, simplifying your administrative load.
  • Automate Your Reminders: Don’t rely on your memory.
